EXPLANATORY NOTE
WHEREAS, pursuant to the provisions of R.A. 7160, otherwise known as the Local Government Code of 1991, the Sangguniang Bayan is empowered to regulate the establishments, operation and maintenance of entertainment or amusement facilities in order to protect the social and moral welfare of the community;
NOW, THEREFORE, on motion of Clr. Frederick D. Lagmay, unanimously seconded, it was:
RESOLVED, as it is HEREBY RESOLVED, to enact an ordinance to read, as follows:

AN ORDINANCE REGULATING THE OPERATION OF DISCO PUBS, BEERHOUSES, VIDEOKE BARS AND SIMILAR ESTABALISHMENTS IN THE MUNICIPALITY OF SISON, PANGASINAN
Be it enacted by the Sangguniang Bayan of Sison, Pangasinan, that:
SECTION I. This Ordinance shall be entitled “An Ordinance Regulating the Operation of Disco Pubs, Beerhouses, Videoke Bars and Similar Establishments in the Municipality of Sison, Pangasinan;
SECTION 2. Definition of Terms:
a. Disco Pubs - a public night club offering recorded music, for dancing while
drinks and foods are served sometimes
b. Beerhouses – are places of business establishments that solely serves/sells beer and other intoxicating drinks to its patrons usually
in the evening
c. Nightspots – are entertainment places that operate at night time for adults seeking pleasure, enjoyment and relaxation and whose main attraction are the hospitality girls and the shows featuring these women
d. Videoke Bar- is a place of business where in the main feature is to give the customers a chance to sing with the aid of a videoke system
e. Food handlers- are employees of the establishment serving foods and beverages to customers
f. Guest Relations
Officer(GRO) - refers to girls/ladies rendering friendly or liberal reception of guests or customers who, most of the time, entertains sits or go out with the customers
g. Bouncer - a person employed by the business owner to ensure peace and order within the premise of the business establishment
SECTION 3. Regulatory Provisions:
3.1. It shall be illegal for Disco Pubs, Beerhouses, Videoke Bars and similar establishments to operate within the 200 meter radius distance from churches, schools, government institutions and residential areas in the Municipality of Sison, Pangasinan;
3.2. All owners of business establishments mentioned in the preceding section shall be allowed to operate provided that they comply with the requirements set forth by the Offices of the Municipal Mayor, Municipal Health Officer, Municipal Treasurer and the Office of the PNP of Sison, Pangasinan;
3.3. That the herein establishments shall maintain a Security Guard or a Bouncer with the corresponding permit to work which shall be secured from the Office of the Municipal Mayor and the fee to be paid at the Office of the Municipal Treasurer;
3.4. That firearms and other deadly weapons shall not be allowed inside these establishments and that a mandatory physical inspection of the possession of such deadly weapons shall be conducted before any customer is allowed to enter the premises. Guns or deadly weapons found shall be deposited with the Security Guard of the business establishment or to the Bouncer of the establishment and can only be retrieved when the owner desires to leave the place;
3.5. That the owner shall only employ persons at least eighteen (18) years of age. Violation of the herein provision shall be a ground of the outright closure of the business establishment;
3.6. That the subject business establishments shall not allow individuals eighteen (18) years below to enter their business establishments;
3.7. That business owners, food handlers and GROs shall be subjected to tests and examinations, as follows:
Business Owners and Food Handlers:
a. Hepatitis B- once a year
b. Sputum- upon securing working permit
c. Fecalysis- upon securing working permit
Guest Relations Officer:
a. HIV - every six (6) months
b. Hepatitis – upon hiring
c. Hepatitis B (Immunization) – monthly until 3 doses is complete
d. Smear- Weekly
e. Drug Test- every six (6) months
3.8 It shall be mandatory to Business Owners to register their GROs and secure the corresponding working permit of the said workers at the Office of the Mayor;

SECTION 4. Penalty Provisions:
Violations committed by owners in any of the provisions stated in the preceding section shall be meted the following penalty:
a. First Offense - P2,000.00
b. Second Offense - Closure of the business establishment
SECTION 5. The Office of the Mayor through its concerned department, the Chief of Police and the Municipal Health Officer shall exercise all the powers mandated to them under the Local Government Code to implement this ordinance;
SECTION 6. All Ordinances previously enacted that is found inconsistent with the provisions of the herein ordinance is hereby repealed;
SECTION 7. This Ordinance shall take effect immediately upon approval of the Sangguniang Panlalawigan;
